STATEMENT FROM EXECUTIVE DIRECTOR PETER J. SKANDALAKIS RE: SUPREME COURT DECISION THE STATE V. ROMAN
The Prosecuting Attorneys’ Council of Georgia is aware of the Georgia Supreme Court decision in THE STATE v. ROMAN, S25C0587, S25C0588, S25C0589, S25C0590, S25C0591, S25C0592, S25C0593, S25C0594, S25C0595. PAC has obtained a copy of the order and has reviewed it thoroughly. The order denied the petition for certiorari. We are also aware that District Attorney Fani Willis has indicated she will not request the court to reconsider its decision regarding this matter. The cases decided by the Supreme Court will now, in accordance with legal procedures, be remitted by the appellate courts to the Fulton County Superior Court. At that point, PAC will be officially notified of the disqualification of District Attorney Willis and her office from the cases. Realizing that the case will ultimately land at PAC, the search for a conflict prosecutor will begin today. PAC will fulfill its duty under O.C.G.A. § 15-8-5(a) to appoint another prosecutor to take over the cases. When that decision is made, it will be announced at the appropriate time. Until then, any action on PAC’s part is premature, and we have no further comments, pursuant to Georgia Rule of Professionalism 3.8 Special Responsibilities of a Prosecutor.
