Assistant District Attorney
The Cherokee Judicial Circuit District Attorney’s Office has an opening for a county-paid Assistant District Attorney in the Bartow County office (Cartersville). The following duties are normal for this position:
• An Assistant District Attorney reviews reports submitted by law enforcement to determine whether further investigation is needed; approves or returns cases for more work; researches alternative crimes; reads and researches case law; determines if crimes alleged are supported by probable cause.
• Drafts accusations and indictments with charges supported by the evidence; evaluates and researches potential defenses; negotiates pleas to dispose of cases; dismisses cases not prosecutable.
• Develops trial strategy for each viable case; meets with witnesses and crime victims; answers victims’ questions; determines appropriate sentence recommendations; attends all assigned court calendars to take pleas, conduct hearings, and administer all other non-trial matters; attends pre-trial conferences with judges and defense attorneys.
• Subpoenas appropriate witnesses for motions and trials; researches and argues all pre-trial and post-trial motions; files motions in the appropriate time frame; complies with discovery requirements and keeps crime victim apprised of all key stages of a criminal case; tries cases before juries and judges.
Other duties may be assigned from time to time.
Applicants should be of strong moral character and committed to enforcing the law with impartiality and with a commitment to justice. Good communication and interpersonal skills are essential. Applicants should be able to handle a large volume of work in a fast-paced environment with the ability to shift focus often.
Minimum qualifications: All applicants must be a member in good standing with the State Bar of Georgia or be in good standing of another state’s bar association that is eligible for reciprocity admittance to the State Bar of Georgia; and be admitted to practice before the Georgia Supreme Court and Court of Appeals. All candidates are subject to a background check. Applicants selected for hire will be subject to fingerprinting, a criminal history background check, a motor vehicle driver’s history check and pre-employment drug screening; employment is contingent upon the completion and satisfactory results of each investigation.
