Assistant Solicitor

CLASSIFICATION TITLE: ASSISTANT SOLICITOR – SOLICITOR’S OFFICE

The purpose of this job is the prosecution of misdemeanor violations in the Jackson County State Court. Duties and responsibilities include, but are not limited to, the investigation and preparation of cases for trial, representing the State in all stages of court proceedings, and performing additional tasks relating to the function of the department as assigned by the Solicitor.

ESSENTIAL JOB FUNCTIONS:

The following duties are normal for this job. These are not to be construed as exclusive or all-inclusive. Other duties may be required and assigned.

  • Reviews reports submitted by law enforcement to determine whether further investigation is needed; approves or returns cases for more work; researches alternative crimes; reads and researches case law.
  • Drafts accusations and ensures accusations are properly prepared, that criminal histories are with case files and that relevant documents and evidence are collected and placed in case files.
  • Evaluates and researches potential defenses; negotiates pleas to dispose of cases; dismisses cases not prosecutable.
  • Develops trial strategy for each case; questions witnesses; determines appropriate sentence recommendations; calls arraignment calendars; attends pre-trial conferences with judge and defense attorneys.
  • Subpoenas appropriate witnesses for motions; researches and argues all pretrial and post-trial motions; files motions in appropriate time frame prior to trial. Complies with discovery requirements.
  • Performs other duties as assigned.

ADDITIONAL DUTIES:

  • Interviewing witnesses and victims in criminal cases and police officers involved in criminal investigations.
  • Assisting other attorneys in Solicitor’s Office perform their duties.
  • Visiting crime scenes.
  • Preparing visual aids for trial.
  • Presenting training to police officers as requested by police departments.

KNOWLEDGE, SKILLS AND ABILITIES:

  • Knowledge of Georgia State Law.
  • Knowledge of departmental policies and procedures.
  • Knowledge of modern office procedures.
  • Skill in interpersonal relations.
  • Skill in oral and written communication.
  • Skill in operating office equipment such as a computer.
  • Legal research skills.

PHYSICAL DEMANDS & WORK ENVIRONMENT:

  • Work is typically performed while sitting at a desk with intermittent standing, stooping, and walking.
  • Work is typically performed in an office or courtroom.

DISCRETIONARY AUTHORITY & JUDGMENT EXERCISED:

The Supervisor assigns work in terms of general instructions that require the use of judgment. Guidelines consist of standard operating procedures, department rules and regulations, county policies, Code of Professional Responsibility and Conduct, Rules of the Superior Court and Georgia State Law. These guidelines require judgment, selection and interpretation in application.

SUPERVISORY & MANAGERIAL RESPONSIBILITY:

Provides guidance to investigators and senior court clerk for selection and preparation of pending cases to be prosecuted.

MINIMUM QUALIFICATIONS:

Must be a member in good standing with the State Bar of Georgia or with another state’s bar association that is eligible for reciprocity admittance to the State Bar of Georgia; and be admitted to practice before the Georgia Supreme Court and Court of Appeals. Experience in a prosecutorial clinic, Solicitor’s Office or other District Attorney’s Office is preferred, not required. All candidates are subject to a background check. Applicants selected for hire will be subject to fingerprinting, criminal history background check, motor vehicle driver’s history check and pre-employment drug screening; employment is contingent upon the completion and satisfactory results of each investigation.
