Open Records and Records Restriction Training
The Prosecuting Attorneys’ Council of Georgia presents the Open Records and Records Restriction Training.
Attendees who register for this FREE training will get a two‑for‑one experience, as we’ll be covering both topics in a single training.
Open Records
This training will explore the Open Records Act’s core requirements, including the duty to make records available, the obligation to respond within the “three-day rule,” and the circumstances under which a public agency may charge for producing responsive records. We will also examine the categories of records exempt from disclosure, with special attention to law enforcement and prosecutorial records. In addition, the session will include a review of Georgia appellate court decisions interpreting key provisions of the Act.
Records Restriction
This training provides an overview of Georgia’s records restriction laws and the circumstances under which criminal history record information may be restricted or sealed. Participants will examine the requirements and procedures for restrictions occurring before and after indictment or accusation, as well as petition-based restrictions involving misdemeanors, reversed or vacated convictions, dead-docketed cases, human trafficking victims, and pardons. The presentation also addresses clerk’s records, First Offender cases, conditional discharges, access to restricted records, and the effective date and application of the current statute.
*Trainings are not open to the public. Attendance is limited to staff employed by law enforcement or government agencies.
